Terms of service
1. Scope of Application
1.1 The following general terms and conditions apply exclusively to business transactions with collectorsdeal.com. They are binding for all current and future business transactions of all customers with collectorsdeal.com, even without special reference. Deviations require written form.
2. Conclusion of Contract
2.1 By placing an order in our online shop, you make a binding offer to purchase the selected products. The contract is only concluded when we accept your order and ship the products to you. The purchase contract is concluded with Elvion & Friends GmbH, the operator of the online shop.
3. Prices and Payment Terms
3.1 Prices for the products are indicated in our online shop and are inclusive of statutory VAT unless otherwise stated. 3.2 We reserve the right to change prices and product offers at any time. Changes do not affect orders already placed. 3.3 Payment is made according to the payment methods indicated in the order process. You agree that we may store and process your payment information.
4. Delivery
4.1 Products are delivered to the delivery address specified by the customer. Delivery times vary depending on the product and delivery location and are indicated in the product description.
4.2 The customer is responsible for ensuring the accuracy of the delivery address. Costs incurred due to incorrect delivery addresses are borne by the customer.
4.3 If the item is in stock, the delivery time is 2-5 days after receipt of payment. If an item is not in stock, delivery time may be delayed.
4.4 We use Swiss Post for delivery.
4.5 For pre-orders with different release dates, the shipping date of the item released last is always used. Partial shipment is possible by arrangement and may involve additional costs.
Transport Damage
5.1 Collectorsdeal.com assumes no liability for transport damage caused by the carrier (e.g., Post, DHL, FedEx, DPD). Once the goods have been handed over to the carrier, the responsibility for damage-free delivery lies with the carrier.
5.2 If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately. The failure to complain or contact us has no consequences for your statutory claims and their enforcement, particularly your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.
5.3 If the customer picks up the goods, liability ceases upon handover of the goods. Slight damage to original packaging is not accepted as a reason for return unless the customer has explicitly indicated in the order that they wish to purchase the item as a collector's piece.
6. Warranty and Liability
6.1 We guarantee that the products are free from defects at the time of delivery and correspond to the agreed specifications.
6.2 The customer is obliged to check the delivered products for obvious defects immediately upon receipt and to notify us of any defects without delay.
6.3 Our liability is limited to intent and gross negligence. We are not liable for damages caused by improper use of the products or natural wear and tear.
7. Data Protection
7.1 Information on the collection and processing of personal data can be found in our data protection declaration.
8. Final Provisions
8.1 These GTC and all contracts concluded between the seller and the customer are subject to Swiss law. The place of jurisdiction for all disputes is Nidwalden.
9. Changes to the GTC
9.1 The seller reserves the right to change these GTC at any time. The amended GTC will be published on the seller's website and apply from the time of their publication.
10. Cancellations
10.1 For pre-ordered goods, allocations by wholesalers may occur. Each item for which such a possibility exists contains an additional note in the product description. In the case of an allocation, cancellations may occur on our part. In such cases, the customer receives a full refund of the purchase price. There are no cancellation fees for the customer. If one of the following payment methods was chosen and the customer cancels an unshipped (pre-)order of their own accord, the following cancellation fees apply for the customer:
- Shopify Payments: 3% of the purchase amount
- PayPal: 4.3% of the purchase amount
- TWINT: 3.75% of the purchase amount
11. Right of Withdrawal
11.1 The customer can withdraw from a purchase contract within 7 working days in text form without stating reasons.
11.2 The period begins after receipt of the withdrawal right. To comply with the right of withdrawal, it is sufficient to send the cancellation on time.
11.3 collectorsdeal.com will refund any payments already made. Any costs of returning the product shall be borne by the customer.
12. Return Conditions
12.1 Returns are possible within 10 days of receiving the shipment or after picking up at collectorsdeal.com in Nidwalden.
12.2 Only items that are in their original packaging, unused, clean, returned complete, and undamaged, including the receipt, will be accepted.
12.3 Individual cards and booster packs are excluded from return.
13. Pre-orders Terms & Conditions
These Terms & Conditions apply when you pre-order an item from Collectorsdeal.com by placing a pre-order, you are agreeing to be bound by these Terms.
13.1 What does purchasing a product that is labeled "Pre-Order" mean?
It means we are currently sold out of that product but are expecting more in the very near future or the product is new to the market or to our shop and is not yet in stock. You're essentially reserving that product so when it comes (back) in stock, yours will ship out immediately.
13.2 How long will it take for my pre-ordered product to ship?
The timeframe can vary from product to product. Please see the product, you're interested in pre-ordering, for an estimated shipping timeframe.
Any orders containing a preorder item will not be shipped until the preorder item becomes available to ship. Guarantees of product (re-)stock dates cannot be confirmed but every effort will be made by the shop to have products ready for shipping as soon as possible. Collectorsdeal.com reserves the right to change the preorder shipping dates at any time if required based on the above factors. If you have purchased a preorer item(s), you have acknowledged and accepted these conditions provided regarding preorder item(s). Preorders will not be cancelled if the customer fails to acknowledge the delayed shipment for presale items.
13.3 Will I be charged before my item ships?
Pre-order payments do not guarantee availability of the item but represent your offer (“Offer”) to buy the item when it is generally released for sale. We reserve the right not to accept your Offer and the your Offer is only accepted once the Pre-ordered item is despatched.
When you place a Pre-order, you will need to pay the full upfront price of the item. You may cancel your Pre-order and get a full refund of your Pre-order Payments at any time before the item has been despatched.
13.5 What if my order has products that aren't labeled as "Pre-Order" as well?
If your order has products that aren't on pre-order and products that are on pre-order, all products within your order will ship when your pre-order products ship. If you would like your products that aren't on pre-order immediately, please place 2 separate orders. One with currently in stock products and one with pre-ordered products.
Products that are available for pre-order will be marked as "Pre-Order" in the products name and a disclaimer in the product description.
13.6 Distributor Allocation (Limiting of items received)
What is allocation?
Distributors receive a certain amount of product from their manufactorers and sometimes if certain products are in high demand, they will only receive a certain number of specific items despite however many they have pre-ordered. This means that they will then take the number received and "allocate" a portion of those to each of their retailers (ex: Collectorsdeal.com). This means that even if Collectorsdeal.com ordered 20 of a specific item and that has been accepted by my distributor -- if that item is in high demand, we may only receive 5 of them.
What does this mean for you?
This means that we will most likely be limiting the number of pre-orders that we can take at a given time on specific more high demand items, in order to prevent disappointing folks if we don't receive all of them. This means if we do in fact receive the amount we order, and there is no allocation, we can open pre-orders back up closer to release date. If for some reason even with limiting pre-orders, the distributor still allocates only a certain number of them to me, we will split them up between existing orders and if you purchased more than one, you may receive less than the full number you purchased.
Collectorsdeal.com will also be endeavoring to have multiple distribution methods to hopefully not have this happen-- and we will do the best to fill the orders in some other way (ordering from another retailer if possible, etc) but there may be extreme situations where we will just need to refund your order entirely.
